Welcome to Triangle's B.E.S.T. Karate & Fitness ("we," "us," or "our"). By accessing or using our website, booking classes, purchasing programs, or participating in our services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our website or services.

1. Description of Services

Triangle's B.E.S.T. Karate & Fitness provides traditional martial arts training, group and private classes, workshops, competitions, and related services. Our website allows users to:

View class schedules and program descriptions.
Book classes, seminars, or introductory sessions via our integrated online calendar.
Submit payments or enroll in monthly payment plans.
View photos, videos, and bios of our facility, instructors, and students.

2. Account Registration and Eligibility

Age Requirement: You must be at least 18 years old to create an account, purchase subscriptions, or register minor students. Parents or legal guardians must register and agree to these Terms on behalf of minors under 18.
Account Security: You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

3. Bookings, Cancellations, and Scheduling

Calendar Reservations: Class bookings made through our online calendar are subject to availability and confirmation.
Cancellation & Rescheduling:
- Class Cancellations: Cancellations for booked sessions should be made at least 24 hours in advance to receive a credit or reschedule without penalty.
- No-Shows: Failure to attend a booked class without prior notice may result in forfeiture of the session or a late-cancellation fee.
Schedule Changes: We reserve the right to alter class schedules, substitute instructors, or cancel sessions due to unforeseen circumstances or low enrollment.

4. Payment Terms, Billing, and Subscriptions

Pricing & Payments: All fees for classes, memberships, and trial programs are stated in [U.S. Dollars, $] and are subject to applicable sales tax. Payment is required at the time of booking or enrollment.
Financial Hardship: If your family experiences a loss of a job or other life event that creates a financial hardship, ask Sensei about our Tuition Waiver that allows you or your children to continue training karate and fitness without interruption or financial pressire. A Tuition Waiver reduces your monthly dues 50-100% for an agreed amount of time.
Recurring Payment Plans (12 month program):
- By enrolling in a recurring membership or payment plan, you authorize B.E.S.T. Karate & Fitness to charge your designated payment method on a recurring basis (e.g., monthly) for a consecutive 12 months.
- If you need to Pause your membership for 1 or 2 months, due to injury, travel, or other personal reason, it is your responsiblity to contact TBK&F staff via email or phone to begin a Pause. You may have a maximum of 2 months or 8 weeks of non-payment and still must complete your 12 months. In other words, you must complete your 12 month commitment within 14 months.
- If you are moving beyond a reasonable commute to the dojo, cancellations will only be entertained with a written or email cancellation notice and documentation of your move (e.g, new uiltity bill with new address.)
Refund Policy:
- All payments, including deposits and subscription charges, are non-refundable after 5 calendar days of your last billing.
- Trial packages or introductory offers are non-transferable and non-refundable.

5. Media Consent and Image Rights (Photos & Videos)

Website Content: The images, videos, and photos of instructors and students displayed on our website are the property of Triangle's B.E.S.T. Karate & Fitness or used with permission. You may not download, copy, or redistribute these images for commercial use.
Student Media Release: By participating in classes or events at Triangle's B.E.S.T. Karate & Fitness, you grant us permission to capture photos and videos of you (or your minor child) for educational, promotional, and marketing purposes on our website and social media platforms.
- Opt-Out: If you wish to opt out of media recording, you must submit a written request to TrianglesBestKarate@Gmail.com prior to participation.

6. Physical Activity Waiver and Assumption of Risk

Health and Fitness: Martial arts training involves strenuous physical activity. By registering for classes, you represent that you (or your minor child) are physically fit and have no medical condition that would prevent safe participation.
Assumption of Risk: You acknowledge that participation in karate carries inherent risks of physical injury. You voluntarily assume all risk of injury, illness, or damage resulting from training, whether on-site at the dojo or following along with online content.

7. Intellectual Property

All content on this website—includingr text, program descriptions, curriculum details, graphics, logos, images, and software—is the property of Triangle's B.E.S.T. Karate &Fitness and protected by copyright, trademark, and intellectual property laws. Unauthorized reproduction or distribution is strictly prohibited.

8. Limitation of Liability

To the fullest extent permitted by law, Triangle's B.E.S.T. Karate & Fitness, its owners, instructors, employees, and agents shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of our website, participation in our classes, or reliance on any website content.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
